Liability Waiver and Release Form

 

Health Declaration: I declare that I am physically fit and have no medical condition that would prevent my participation in these activities. I agree to inform AthLife Performance of any medical or health conditions that may affect my ability to participate safely. I acknowledge that AthLife Performance has recommended that I obtain medical clearance from a licensed physician before participating in any physical activities.

Acknowledgment of Risks: I understand and acknowledge that participating in fitness and athletic activities at AthLife Performance or any activities organised by AthLife Performance whether indoors or outdoors carries inherent risks, including but not limited to personal injury, property damage, or death. I affirm that I am voluntarily engaging in these activities and fully accept and assume all risks associated with these activities. I acknowledge that these risks may be caused by the negligence of AthLife Performance, its agents, employees, or others, or by myself, and that there may be other risks either known or unknown to me or AthLife Performance, or not readily foreseeable at this time.

Waiver and Release: In consideration of being permitted to participate in activities at  AthLife Performance or any activities organised by AthLife Performance whether indoors or outdoors, I, my heirs, personal representatives, or assigns, hereby release, waive, discharge, and covenant not to sue AthLife Performance, its directors, officers, employees, agents, successors, and assigns (collectively referred to as "Released Parties"), from liability from any and all claims, demands, actions, causes of action, suits, judgments, damages, costs, expenses, and any other liabilities whatsoever, including but not limited to those resulting from personal injury, accidents, illnesses, death, and property loss arising from, but not limited to, participation in activities, whether such risks are caused by the negligence of the Released Parties or otherwise.

Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, arising from or in any way related to my participation in activities at  AthLife Performance or any activities organised by AthLife Performance whether indoors or outdoors. This indemnity includes claims based on the negligence of the Released Parties, whether passive or active.

Acknowledgment of Understanding: I have read this waiver and release form, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this waiver freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of all liability to the greatest extent allowed by law. I acknowledge that I have had the opportunity to consult with legal counsel regarding the terms and conditions of this waiver and release form.

Severability: If any provision of this waiver and release form is held to be invalid, illegal, or unenforceable, the remaining provisions shall nevertheless continue in full force and effect. If any portion of this waiver and release form is found to be void or unenforceable, the remaining provisions shall continue in full force and effect, and the void or unenforceable provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable.

Jurisdiction and Governing Law: This waiver and release form shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising out of or in connection with this waiver and release form shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.

Full and Final Settlement: I acknowledge and agree that this waiver and release form represents the full and final settlement of any and all claims I may have against the Released Parties, and that this agreement supersedes any prior agreements, understandings, or negotiations, whether oral or written.
